Terms and Conditions

• "Platform" means the Fomax website, web application, mobile application, and all associated services accessible at fomax.ai and related domains
• "User", "you" means any individual or entity that registers for or uses the Platform
• "Content" means any text, images, videos, data, or other material created, uploaded, or published through the Platform
• "Subscription" means a paid plan that grants access to specified Platform features
• "AI Tools" means Irysh, Social Mind, AI Day Planner, Brainstack, and all other artificial intelligence features within the Platform

• Provide truthful and accurate information during registration
• Maintain the confidentiality of your login credentials and not share your account with third parties
• Notify us immediately at info@fomax.ai of any unauthorised access to your account
• Accept responsibility for all activities that occur under your account

Fomax shall not be liable for any loss or damage resulting from your failure to maintain account security.

3.1 Plans

Fomax offers the following subscription plans, available on monthly or annual billing:

Monthly Billing

• Starter — $19/month: 500 AI Tokens/month, 2 connected social accounts
• Creator — $49/month: 1,500 AI Tokens/month, 5 connected social accounts
• Growth — $99/month: 4,000 AI Tokens/month, 15 connected social accounts
• Business — $199/month: 10,000 AI Tokens/month, unlimited connected social accounts

Annual Billing

• Starter — $199/year: 500 AI Tokens/month, 2 connected social accounts
• Creator — $474.99/year: 1,500 AI Tokens/month, 5 connected social accounts
• Growth — $899/year: 4,000 AI Tokens/month, 15 connected social accounts

The Business plan is currently available on monthly billing only and does not have an annual option.

AI Tokens included in each plan are allocated on a monthly basis and do not roll over. Fomax does not sell standalone AI Token packs; AI Token access is only available as part of a subscription plan.

3.2 Billing

• Subscriptions are billed in advance on a monthly or annual basis through the Apple App Store or Google Play Store, managed via RevenueCat, and charged to the payment method on file with your Apple ID or Google account
• Community mentor appointment bookings are billed separately and directly via Stripe
• All prices are displayed in USD; applicable taxes may apply for Pakistani users
• You authorise the applicable payment processor (Apple, Google, or Stripe) to charge your payment method for the relevant purchase

3.3 Free Trial

Paid plans include a free trial managed through your device's App Store or Play Store subscription. No charge is made during the trial period. You may cancel at any time during the trial without incurring any cost. If you do not cancel before the trial ends, you will be charged the applicable subscription fee.

3.4 Refund Policy

Fomax does not issue refunds for purchases it bills directly, including Community mentor appointment bookings, under any circumstances. Subscription plans are billed through the Apple App Store or Google Play Store; refund requests for subscription charges must be submitted directly to Apple or Google under their own refund policies and are outside Fomax's control. Full details are set out in the Refund Policy.

3.5 Cancellation

You may cancel your subscription at any time via your device's subscription settings, or through the Fomax app where available. Cancellation takes effect at the end of the current billing period. You retain access to paid features until the period ends.

You agree to use Fomax only for lawful purposes. You must not use the Platform to:

• Publish, distribute, or transmit content that is illegal under Pakistani law, including content prohibited under PECA 2016
• Spread misinformation, defamatory content, or content that incites hatred, violence, or discrimination
• Infringe any intellectual property rights of third parties
• Conduct spam, phishing, or unsolicited commercial communications
• Impersonate another person or entity
• Upload or distribute malware, viruses, or malicious code
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure
• Scrape, extract, or systematically download Platform data without authorisation
• Use AI Tools to generate content that is obscene, pornographic, or harmful to minors
• Violate any applicable local, national, or international law or regulation

Fomax reserves the right to suspend or terminate accounts that violate this Acceptable Use Policy without prior notice and without refund.

5.1 Fomax's Intellectual Property

The Platform, including its software, design, AI models, branding, logos, documentation, and all underlying technology, is the exclusive property of Fomax and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform solely for its intended purposes during your active subscription.

5.2 Your Content

You retain ownership of all original content you create and upload to Fomax. By submitting content to the Platform, you grant Fomax a non-exclusive, royalty-free, worldwide licence to host, store, process, and display your content solely for the purpose of delivering the services to you. Fomax does not claim ownership of your content.

5.3 AI-Generated Content

Content generated by Fomax's AI Tools (Irysh, etc.) using your inputs and brand voice is provided to you for your use. Fomax makes no warranty that AI-generated content is original, error-free, or free from third-party intellectual property claims. You are responsible for reviewing all AI-generated content before publishing.

Fomax integrates with third-party platforms including LinkedIn, Instagram, TikTok, X (Twitter), Facebook, and others, as well as payment platforms including Apple, Google, RevenueCat, and Stripe. By connecting these accounts or making a purchase, you:

• Authorise Fomax and its payment processors to access, post, retrieve, or process data on your behalf via their official APIs
• Agree that your use of those platforms remains governed by their own terms of service and privacy policies
• Acknowledge that Fomax is not responsible for changes, restrictions, or disruptions to third-party APIs or payment systems

7.1 Service Disclaimer

Fomax is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free from security vulnerabilities. AI-generated content is provided without guarantee of accuracy, originality, or fitness for a particular purpose.

7.2 Growth Results

Fomax provides tools, analytics, and AI assistance to support your growth goals. We do not guarantee specific results, including follower growth, revenue targets, engagement rates, or business outcomes. Results depend on many factors outside our control.

7.3 Limitation of Liability

To the maximum extent permitted by Pakistani law, Fomax, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. Our total aggregate liability to you for any claims shall not exceed the amount you paid to Fomax in the 3 months preceding the claim.

You agree to indemnify, defend, and hold harmless Fomax and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) content you post or publish through the Platform.

9.1 Termination by You

You may terminate your account at any time by contacting info@fomax.ai or through account settings. Upon termination, your access to paid features will cease at the end of the current billing period.

9.2 Termination by Fomax

• You violate these Terms or our Acceptable Use Policy
• Your account is involved in fraudulent, illegal, or harmful activity
• Continued service would expose Fomax or third parties to legal risk
• You fail to pay subscription fees when due

9.3 Effect of Termination

Upon termination, your right to use the Platform ceases immediately. We will retain your data for up to 90 days after account closure, after which it will be deleted in accordance with our Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any dispute arising out of or in connection with these Terms shall first be referred to good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Lahore, Pakistan.

Fomax reserves the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or in-platform notification. Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance. If you do not agree to the changes, you must stop using the Platform and cancel your subscription.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these Terms without affecting the validity and enforceability of the remaining provisions.

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Fomax with respect to your use of the Platform and supersede all prior agreements, representations, or understandings.
